1. Introduction

ProScape AI ("we," "our," or "us") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our AI-powered landscape design service available at proscapeai.com.

2. Information We Collect

Personal Information

• Account Information: Name, email address, and Google account information when you sign up
• Subscription Data: Billing information, subscription plan, and usage limits
• Usage Information: Credits used, generated images, and feature usage
• Your clients, if you are a landscaper: the client names, contact details, property addresses, estimates and proposals you enter. You decide what goes in and you are responsible for having the right to store it; we hold it for you and use it only to run your account. Deleting a client removes their proposals and the files behind them.

Image Data

• Uploaded Images: Photos you upload for landscape design transformation
• Generated Images: AI-processed results and design outputs
• Drawing Data: Mask areas and design sketches you create

Technical Information

• Device Information: Browser type, operating system, IP address
• Approximate location: when you sign up, the country, region, city and approximate coordinates that Cloudflare works out from your IP address. They are kept on your account as a first guess at where your yard is, and replaced by whatever you tell us
• Analytics Data: Page views, session duration and feature interactions, recorded with Umami. When you are signed in, your account email, plan and account type are attached to these, so they are not anonymous
• Cookies: Authentication tokens and session management data

Location Information

• Geolocation Data: With your explicit consent, we collect your device's GPS coordinates to provide location-based plant recommendations
• Address Geocoding: If you enter an address, we use Google Maps Geocoding API to convert it to coordinates
• USDA Zone: Your hardiness zone selection for plant filtering

Location data is used solely to recommend plants suitable for your climate. We do not track your location over time or share precise location data with third parties for advertising purposes.

3. How We Use Your Information

• Provide AI landscape design services and image processing
• Manage your account, subscription, and billing
• Track your credits and plan limits
• Improve our service quality and user experience
• Send important service notifications and updates
• Comply with legal obligations and prevent fraud

4. Information Sharing and Disclosure

Third-Party Services

• Reading your photo and writing the plan: Google Gemini (Google LLC). The photo of the yard and what you tell us about it are sent to Google to be read and to have the plan written
• Drawing the picture: Replicate (Replicate, Inc., USA) runs the image models that draw your design. Your photo and the instructions for the picture are sent to it
• Street View: if you start from an address instead of a photo, the address is sent to Google and the picture of the property comes from Google Street View
• Climate data: the coordinates of a yard, and nothing that says whose it is, are sent to NASA POWER to look up the winter temperatures its hardiness zone is worked out from
• Email: Resend sends our account and billing emails, and receives your email address to do so
• Cloud Storage: Cloudflare R2 stores the photos you upload, the pictures we draw and your proposal PDFs. These files are reachable by anyone who has their exact address; we do not list them anywhere
• Authentication: Google OAuth for secure login
• Payments: Polar (Polar Software Inc.) sells our subscriptions as the merchant of record. Polar holds your payment details and invoices; we never see your card number
• Analytics: Umami (Umami Software, Inc.) records page views and feature use without cookies. For signed-in users it also receives the account email, plan and account type
• Location Services: Google Maps Platform APIs (Geocoding API) for address lookup and location services. Google may collect technical data when you use these features. For more information, see Google's Privacy Policy
• Customer Support: Crisp chat for customer support, available to logged-in users and loaded only when you open the chat. Crisp processes chat messages, your email address, and name to provide support services. Crisp is operated by Crisp IM SAS, based in France, and support conversations are processed within the European Union. For more information, see Crisp's Privacy Policy
• Web Fonts: Google Fonts serves the heading typeface (Fraunces). Your browser requests the font files from Google, which may log your IP address and browser details. No cookies are set. For more information, see Google Fonts privacy information
• Session Analytics: Microsoft Clarity for session replay and heatmaps, loaded only if you accept optional cookies. Clarity records page interactions (clicks, scrolls, page structure) to help us improve usability. Clarity is run by Microsoft Corporation in the United States, and Microsoft may also use what Clarity collects for its own purposes, including advertising. • How you found us — a small first-party cookie (ps_found, 60 days) remembers the page you were on, the site that sent you and any campaign tags, so that if you sign up we know which channel brought you. It is set only if you accept optional cookies, contains no personal data and is not shared.

We Do Not Sell Your Data

We do not sell, rent, or trade your personal information to third parties for marketing purposes.

5. Data Security

We implement appropriate technical and organizational measures to protect your personal information:

• Secure HTTPS encryption for all data transmission
• Regular security updates and monitoring
• Limited access to personal data on a need-to-know basis
• Secure cloud infrastructure with industry-standard protections

6. Data Retention

• Your designs and the photos behind them: kept until you delete them or delete your account. Deleting a design removes its own files from our storage at the same time. A photo that another design of yours still shows — the original behind a later version, for instance — stays until the last design showing it is deleted. Once a file is removed its address stops answering; a copy held by a network cache can take a short while to clear.
• Your account: kept while it exists. When you delete it, your designs, photos, clients, estimates and proposals are removed, and any proposal link you have shared stops working. We do not keep a copy for a waiting period. If we cannot remove your files at that moment, nothing is deleted and you are told, so that an account is never removed while its files are left behind.
• What we keep after an account is deleted: the record of how many paid operations were run, with your account no longer named on it. We need the totals to reconcile what our suppliers charge us; they no longer identify you. Payment and invoice records are held by our payment provider, not by us. Our server logs, which we use to find faults, can still contain your account's identifier until they are overwritten. If you gave us an email address to receive a guide, that request is recorded separately from any account and is not removed with it; write to us and we will remove it.
• Backups: our database backups are taken on a rolling schedule and overwritten. Data you delete can persist in a backup until it rotates out.
• Analytics: held by the analytics providers named in section 4, under their own retention periods.

7. Your Rights (GDPR & CCPA)

You have the following rights regarding your personal information:

• Access: Request a copy of your personal data
• Rectification: Correct inaccurate or incomplete information
• Erasure: Delete your personal data ("right to be forgotten")
• Portability: Export your data in a machine-readable format
• Objection: Object to processing of your personal data
• Restriction: Limit how we process your personal data

To exercise these rights, contact us at [email protected]. You can delete your designs, your clients and your whole account yourself, from inside the product.

Why we are allowed to use your data

• To provide the service you signed up for (performance of a contract): your account, your photos and designs, your clients and proposals, your credits and plan
• With your consent: optional cookies, session replay, the attribution cookie, and your device's location. You can withdraw consent at any time
• Our legitimate interest in running and improving the product: usage analytics, fault logs and preventing abuse
• To meet legal obligations: records the law requires us to keep

Complaints

If you believe we have handled your data wrongly, you can complain to the Romanian data protection authority, ANSPDCP (dataprotection.ro), or to the authority in the country where you live.

8. Cookies and Tracking Technologies

We use cookies and similar technologies for:

• Authentication and session management
• Remembering your preferences and settings
• Analytics to understand how our service is used
• Improving website performance and functionality
• Customer support chat functionality (Crisp — set only when you open the chat)
• Session replay and heatmaps (Microsoft Clarity — set only if you accept optional cookies)
• Remembering how you found us (ps_found — set only if you accept optional cookies)
• Google Maps Platform services (location features)

You can change your choice for optional cookies at any time via the "Cookie Settings" link in the footer, or through your browser settings. Note that disabling certain cookies may limit your ability to use some features, including customer support chat and location-based plant recommendations.

For users in the European Economic Area (EEA): We comply with the EU User Consent Policy. Certain cookies from Google Maps services are only set with your consent when you use location features.

9. Location Data and Consent

Our Design Assistant feature uses location data to recommend plants suitable for your climate zone. Here's how we handle location data:

• Explicit Consent: We request your permission before accessing your device's GPS location
• Purpose Limitation: Location data is used solely for plant recommendations, not for advertising or tracking
• Data Minimization: We only store the minimum location information needed (coordinates, USDA zone, ecoregion)
• Revocable Consent: You can revoke location access at any time through your browser settings or by choosing the "Skip" option
• Alternatives Available: You can manually enter your USDA zone or skip location entirely

When you use address lookup, we send your entered address to Google Maps Geocoding API to convert it to coordinates. This data is processed according to Google's Privacy Policy.

10. International Data Transfers

Our application and its database run on Oracle Cloud in Ashburn, Virginia, USA, and most of the services named above are in the United States too. Your data is therefore processed in countries outside your residence, including the United States. We ensure appropriate safeguards are in place for international transfers, including Standard Contractual Clauses (SCCs) and adequacy decisions, in compliance with GDPR and other applicable data protection laws.

11. Children's Privacy

Our service is not intended for anyone under 18 years of age. We do not knowingly collect personal information from anyone under 18. If you believe we have collected information from somebody under 18, please contact us immediately.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Last updated" date. Continued use of our service after changes constitutes acceptance of the updated policy.
